Mr. Eaglesfield has been Senior Counsel at Price Waicukauski & Riley, LLC since 2006. His work is primarily concerned with environmental litgation, environmental consulting, and business litigation. He is currently involved in litigation representing taxpayers, who are seeking, from the City of Indianapolis, a refund of an assessment they promptly paid in full for a new sanitary sewer line in their neighborhood, in an amount equal to the amounts their neighbors, who elected to pay the assessment in installment, were forgiven by a Resolution of the Indianapolis Board of Public Works.
Mr. Eaglesfield has had an illustrious career that spans over three decades of experience. He has received an AV rating from Martindale Hubbell, the highest ratings for quality and ethics. He has been designated a Super Lawyer by Indianapolis Monthly magazine in 2005.
Over the years, Mr. Eaglesfield has represented a wide range of clients in a variety of venues in matters, involving a wide range of issues. He has participated in appeals to the Indiana Court of Appeals, Indiana Supreme Court, Federal Circuit Courts for the Sixth and Seventh Circuits, and United States Supreme Court.
He successfully litigated a settlement whereby past dry cleaner operators cleaned up a client's property and secured indemnity for her against any future cleanup costs. Davy developed successful legal theories and arguments for a Fortune 500 corporation against the
United States , in an action that resulted in the client recovering past due environmental costs under a contract of indemnity regarding the Manhattan Atomic Bomb Project. He has negotiated Superfund, RCRA, and Wetland remediations throughout the country, and has represented Plaintiffs and Defendants in toxic tort cases. He has litigated and been involved in the resolution of numerous environmental contribution and cost recovery actions. Mr. Eaglesfield has also published extensively on topics including toxic mold and Environmental Liability. He has also served as an expert witness on behalf of a business seeking insurance coverage against its insurer for environmental clean up costs to the insured property.
Mr. Eaglesfield received a Bachelor of Arts degree in Economics from
Indiana University . After earning his degree, he went on to achieve the rank of Lieutenant while serving in the United States Navy.
Following his military service, Davy graduated summa cum laude at the top of his class from Indiana University School of Law at
Indianapolis in 1971. While in law school, Mr. Eaglesfield was the Associate Editor of the Indiana Law Review. He is admitted to practice law in the State of Indiana; the Eastern District of Michigan and the Southern and Northern Districts of
Indiana of the U.S. District Court; U.S. Seventh Circuit Court of Appeals; and the U.S. Supreme Court.
