Product Liability (Non-organic milk)

On December 4, 2007, Price Waicukauski & Riley, LLC filed a class action complaint on behalf of Plaintiffs Patrick and Caryn Hudspeth, ("Plaintiffs") Target Corporation ("Defendant") regarding organic milk. The supposedly "organic" milk was provided by Aurora Dairy Farms for Target stores across the country and labeled with Targets brand name, "Archer Farms".

The market for organic milk has increased in number over the last several years. Consumers rely on manufacturers and sellers of milk products to determine what milk is in fact organic. The Defendant's organic milk displays an organic certified label to assure consumers that the milk complies with the Organic Foods Production Act of 1990 However, Defendant's milk was not organic, because among other things, the milk was produced in large factory farms and failed to comply with federal law. The Defendant violated federal and state law by mislabeling the milk product and misleading consumers into paying a higher price for such items. In addition, by failing to maintain a proper "organic" environment for the cows and misrepresenting the product Target was selling as "organic" the Defendant violated several codes of conduct. The dairy farm has been placed under a period of probation by the USDA, but will still be able to hold its license in managing an organic atmosphere for their cows if proper changes are made.
