Bad Faith Insurance Class Action
On March 1, 2007, Price Waicukauski & Riley, LLC filed a class action complaint on behalf of a putative class against Defendant State Farm Insurance due to State Farm's bad faith in refusing to pay hail damage claims.
On April 14, 2006, central Indiana was hit by a number of powerful storms, which caused severe hail damage to roofs across the area. The named plaintiffs all made claims for this damage to their homeowner's insurance company, State Farm Insurance. State Farm acted in bad faith in denying the claims of the Plaintiffs and the members of the putative class. According to local news reports, the putative class contains approximately 7,000 central Indiana homeowners who had their hail damage claims denied by state farm.
The experience of the putative class members is in stark contrast to their neighbors who carry homeowners insurance from different insurance providers, most of whom had their hail damaged roofs replaced. However, when putative class members insured by State Farm filed a claim to have their roofs replaced, thousands were denied.
