What are Aqua Dots?
Aqua Dots are small colored beads that are covered with a coating, that when mixed with water causes the beads to stick together.

What are the legal and medical issues with Aqua Dots?

On November 7, 2007, the U.S. Consumer Product Safety Commission recalled 4.2 million Aqua Dot toys ("Aqua Dots" or "beads") manufactured by Spin Master, Inc. and Spin Master, Ltd., ("Defendants"), from April of 2007 through November of 2007.

The coating on Aqua Dots’ beads contains a chemical that can turn toxic when ingested. Defendants marketed and labeled Aqua Dots as being safe for children; however children who swallow the beads can become comatose, develop respiratory depression or have seizures.

On November 20, 2007, Price Waicukauski & Riley, LLC filed a class action complaint on behalf of Eric K. Botsch ("Plaintiff") against the Defendants. Plaintiff purchased Aqua Dots for his three young children on November 2, 2007, from a Toys 'R' Us in Dallas, Texas. If the Plaintiff had known that Aqua Dots had the potential of causing substantial harm to his children, he would not have purchased the toys.

The Defendants have offered to "replace" the beads with another Spin Master toy, but are not offering to refund consumers the purchase price. Plaintiff finds this remedy to be unjust in comparison to the substantial harm and/or risk of harm the Defendants' product has caused to children. If you have any Aqua Dot toys they should be taken away from children immediately.
