Price Waicukauski & Riley, LLC filed a class action lawsuit against the defendants for violations of the federal RICO statute, state consumer protection laws, and unjust enrichment for their unlawful scheme to market and sell products purporting to contain a patented molecular resonance effect technology ("MRET"), which they claim are designed to protect humans from the harmful effects of electromagnetic radiation caused by electromagnetic devices, such as cell phones, televisions, vacuum cleaners, and automobiles. The defendants have stated, among other things, that the efficacy and mode of operation of these products has been scientifically tested.
Both federal and state laws prohibit companies from using false and deceptive statements about a product when selling that product to consumers. In this lawsuit, the Plaintiff alleges that the Defendants engaged in a conspiracy to fraudulently market and sell products purporting to contain MRET technology for the purpose of protecting humans from electromagnetic radiation. According to the Complaint, there is no scientific basis supporting the efficacy or mode of operation of MRET technology and that the evidence in support of its claims has been characterized as "science fiction."
