By law, insurance companies owe their customers “good faith and fair dealing”, which in essence means that they must deal with their customers in an honest and fair manner. Your insurance company must:

  • Cooperate with you regarding your claim.
  • Provide a timely response to your communication with them.
  • Attempt to find a basis to pay the claim instead of searching for reasons not to pay your claim.
  • Inform you in writing exactly why your claim is being denied. This letter must the contract term or provision that supports their denial.

Insurance companies are required to ‘willingly’ pay claims properly and promptly in “Good Faith”. It is illegal to ‘willingly’ not pay, discount-lowball, delay, deny payment of legitimate claims in “Bad Faith”

If you believe that your claim has been unfairly denied or that the insurance company has acted in a dishonest manner, we encourage you to pursue your claim. Your claim may result in a recovery amount larger than the original face value of the policy as the insurance company may also be required to pay damages for breach of contract.
